Der Bundesgerichtshof hat mit Urteil vom 10.01.2019 (Az. III ZR 325/17) bestätigt, dass § 17 Abs. 3 S. 1 KHEntgG als zwingende preisrechtliche Schutzvorschrift zu Gunsten des Patienten nicht nur einer Honorarvereinbarung entgegensteht, die ein Honorararzt unmittelbar mit dem Patienten abschließt, sondern auch verbietet, den Honorararzt in der Wahlleistungsvereinbarung als „originären“ Wahlarzt zu benennen. Derartige Vereinbarungen sind gem. § 134 BGB nichtig. § 17 Abs. 3 Satz 1 KHEntgG legt den Kreis der liquidationsberechtigten Wahlärzte abschließend fest und schließt wahlärztliche Leistungen durch Honorarärzte aus.
