Stellenwert eines Gutachtens einer medizinischen Schlichtungsstelle im Arzthaftungsprozess

Der Bundesgerichtshof hat mit Beschluss vom 12.03.2019 (Az. VI ZR 278/18) entschieden, dass das Gutachten einer medizinischen Schlichtungsstelle im Arzthaftungsprozess im Wege des Urkundenbeweises gewürdigt werden kann. Dies führe aber weder zu einer Erhöhung der Darlegungslast des Patienten noch sei das Schlichtungsgutachten auf Beweisebene geeignet, den Sachverständigenbeweis zu ersetzen.
