Wirtschaftsstrafrecht - Mehrfaches Gebrauchen gefälschter Dokumente als eine Urkundenfälschung

Bei Wirtschaftsstraftaten wie Betrug (§ 263 StGB) oder Untreue (§ 266 StGB), ist eine typische Vorbereitungs- oder Begleittat häufig eine Urkundenfälschung (§ 267 StGB). Diese kann auch dadurch begangen werden, dass eine gefälschte Urkunde gebraucht wird. Mit Beschluss vom 10. April 2018 (Az. 5 StR 75/18) hat der Bundesgerichtshof klargestellt, dass aber auch dann nur eine Straftat vorliegt, wenn eine gefälschte Urkunde dem ursprünglichen Tatplan entsprechend mehrfach gebraucht wird. Dies hatte das Tatgericht in dem zu entscheidenden Fall verkannt, so dass der Schuldspruch entsprechend geändert werden musste.
