Revisionsrecht – Doppelrelevante Aspekte bei der Strafzumessung möglich

Im Revisionsverfahren beschränkt sich die Überprüfung der Strafzumessung des Tatrichters darauf, ob ihm bei der Bemessung der Rechtsfolge Rechtsfehler unterlaufen sind. Ein solcher kann auch in einem Wertungswiderspruch liegen. In einem Beschluss vom 19. Juni 2018 (Az. 4 StR 217/18) hat der Bundesgerichtshof insoweit aber noch einmal darauf hingewiesen, dass ein Umstand, der sowohl strafmildernde wie strafschärfende Aspekte aufweise, durchaus in beide Bewertungsrichtungen hin bei der Strafzumessung berücksichtigt werden könne.
