Keine Werbegeschenke bei Kauf rezeptpflichtiger Medikamente

Apotheker dürfen ihren Kunden beim Erwerb verschreibungspflichtiger Arzneimittel keine Werbegaben gewähren. Dies gilt selbst dann, wenn es sich um geringwertige Gaben wie einen Brötchen-Gutschein oder einen 1-Euro-Gutschein für die eigene Apotheke handelt. Auch solche Werbegaben sind nach den neuesten Urteilen des Bundesgerichtshofs vom 06.06.2019 (Az. I ZR 206/17 und I ZR 60/17) wettbewerbsrechtlich unzulässig.
