Bundessozialgericht hebt EBM-Regelungen auf

Von einer Institutsermächtigung dürfen zwingend zu erbringende Begleitleistungen nicht ausgenommen werden. Gegenteilige EBM-Regelungen sind verfassungswidrig und daher unwirksam. Dies hat das Bundessozialgericht mit Urteil vom 25.01.2017 (B 6 KA 2/16 R) entschieden und gab einem Universitätsklinikum recht. Danach muss der Bewertungsausschuss die Gebührenpositionen für die Beobachtung und Betreuung krebskranker Kinder neu fassen. Das Universitätsklinikum hatte eine Institutsermächtigung für die konsiliarische Beratung, Diagnostik sowie Behandlung onkologischer und hämato-onkologischer Erkrankungen im Kindesalter. Einen Antrag auf Erweiterung der Ermächtigung auf die Zusatzpauschalen für Beobachtung und Betreuung (Nummern 01510 bis 01512 EBM) lehnten die Zulassungsgremien in Nordrhein jedoch ab.
